Proposal to constitute Indian Judicial Service IJS
The central government has revived the proposal to constitue Indian Judicial Sevice like IAS, IPS., (Times of India - 24-09-2016).
Article 312 of the Indian Constitution deals with the all India services like IAS, IPS., In original constitution did not provide Indian Judicial Sevice.
All India Judicial Sevice prposed in 1960. The constitution amended in 1977 to provide Indian Judicial Sevice (Ref: art 312).
Central government has not taken steps for the same since 1977.
It is learnt that Central Law Minister Ravi Sankar Prasad held two rounds of meetings and instructed the officials to prepare a detailed proposal, which could be brought before the cabinet.
Article 312(3) says that Indian Judicial Sevice shall not include any post inferior to the district judge. i.e., district judges will be recruited directly by the Union Public Service Commission.
State Public Service Commissions, under the guidance of high court, will continue to recruit civil judges/ magistrates for the lower courts.
This idea has to be submitted before the bar and suggesstions have to be heard from advocates community before making decision on Indian Judicial Sevice.
